In short
- You need an account for most features and you are responsible for it.
- You keep ownership of what you post; we need a licence to show it.
- Sellers, drivers, hosts and other partners have extra terms for their role.
- We can limit accounts for fraud or abuse, and every decision can be appealed.
1Scope of these terms
These terms apply to every product offered by Ayde, including shopping, marketplaces, food, travel, mobility, media, communities and payments. Some products have additional terms, for example the seller terms or the payments and wallet terms. If a product term conflicts with these terms, the product term applies for that product.
2Your account
You must be at least 16 years old to open an account, or the age of digital consent in your country if it is higher. Business accounts must be opened by a person authorised to act for the business.
Keep your sign-in details private. You are responsible for what happens under your account until you tell us that it has been compromised.
3Using the products
You may use the products for personal purposes and, with a business account, for the business purposes the product is built for. You may not:
- break the law, or help anyone else break it
- scrape, copy or resell the service or its content without written permission
- interfere with security features or the normal running of the service
- create fake accounts, reviews, orders or engagement
4Content you post
You keep ownership of the text, photos, videos and other content you post. You grant Ayde a worldwide, non-exclusive, royalty-free licence to host, show, adapt for display and distribute that content on the products, for as long as it is on the platform.
You confirm that you have the rights needed to post the content and that it follows the community guidelines.
5Buying and selling
When you buy from a third-party seller, restaurant, host or driver, the contract for the goods or service is between you and that partner. Ayde provides the platform, the payment flow and buyer protection as described in the refunds policy.
Prices, fees and delivery charges are shown before you confirm an order.
6Fees
Using the consumer products is free unless a price is shown. Partner fees and commissions are published per product and category, and are shown before a partner confirms a listing or campaign.
7Suspension and appeals
We can remove content or limit an account when it breaks these terms or the law, or to protect other users. We tell you why, unless the law or an ongoing investigation prevents it. Every decision can be appealed from the notice you receive, and appeals get a written answer.
8Liability
Nothing in these terms limits liability that cannot be limited by law, including liability for intent, gross negligence or injury. Otherwise our liability is limited to foreseeable damage typical for the contract.
9Changes and termination
We announce material changes to these terms at least 30 days before they apply. You can close your account at any time from your settings.
10Applicable law
Consumers keep the protection of the mandatory law of the country where they live. Disputes can also be brought before the courts of that country.
11Business loyalty programs
Businesses on Ayde can run their own points program. Each program belongs to one business only: its points are earned and spent at that business and can never be moved to, combined with or spent at another business. They are separate from Ayde Rewards.
Points have no cash value and cannot be sold, transferred or exchanged for money. The business funds every discount given for its points.
When you spend points at checkout they are reserved with the order and taken only if the order is placed. If the order is cancelled or refunded, the points you spent are returned and points you earned on it are removed.
Points expire 12 months after your last activity in that program. Levels (tiers) are based on points confirmed in the last 12 months and can go down when older points leave that window. You get a notice before points expire and when your level changes.
A business gives at least 60 days notice before closing its program. Ayde may freeze a program or a member card when it detects fraud or misuse.
12Radio recording (personal use only)
Where a station allows it, the Ayde Radio recorder lets you keep a copy of what you listen to for your own private, personal use. A recording is made and kept on your own device. Ayde does not store, receive or have access to your recordings.
You are responsible for complying with the law of your country, including copyright and private-copying rules. In some countries private copying is restricted or not allowed, and the recorder is switched off there. Each recording is limited to 30 minutes.
Radio stations and rights holders can switch the recorder off for a station, and can reach us at any time through the Recording and rights page linked from every station page. When you use a recording you must not:
- redistribute, publicly perform, broadcast, upload, share or sell a recording
- use a recording commercially or as part of another work
- try to get around a station opt-out or a country restriction
